On 18 August 2014, a 13-year-old living in Ankara was raped by Ahmet Ç who forcefully entered her home. The young girl had previously been harassed by the rapist.
A lawsuit was filed against the man who denied complaints in his testimony in the 7th Assize Court of Ankara about the ‘deprivation of the liberty of the person’, ‘the violation of the housing immunity’, and ‘sexual abuse of the child’.
The court sentenced the man to 8 years in prison, finding him guilty of only attempting to sexually abuse a child.
The court today overturned the sentence, which it deemed excessive, citing “the defendant’s attitudes observed at the hearing.” The predator was given time off for good conduct. The rapist’s sentence was reduced to 6 years and 8 months.
Ülkü Akbaba, the child’s lawyer, appealed the decision. The court held:
“Since it was understood that the defendant did not make a statement about the quality of sexual assault, and upon the resistance of the victim, it was understood that he left the action without any external reason preventing him from completing his action except for his resilient strength, and it is illegal to establish a child’s right to commit a quality sexual abuse crime as written without regard to the fact that it constitutes the crime of simple sexual abuse of the child.”
