THE RIGHT TO DEFENSE CANNOT BE LIMITED
“In this statement, we are clearly reciting human rights law as the bar associations; at any stage of the investigation and prosecution, the suspect or the defendant to interview, to take into interrogation for the duration of the query cannot be prevented the right to legal assistance.
There must be attorney-client privilege. Between the suspect or the defendant and their attorney, they must be able to discuss in an environment that others cannot hear, so the correspondence cannot be subject to control.
This right, and therefore the right to defense, cannot be restricted. Those who act in contradiction to this and the commanders of it, are openly committing crimes.
TORTURE IS GOING UNPUNISHED
The most despicable attack on human existence and dignity, interrogation and punishment as part of many investigations in law enforcement units that the bar was recorded, said: “No one should doubt that we will start an interrogation process in the circumstances that someone has been tortured. The responsible for the act will answer in the courts of the Law.”
Although it was determined that torture had been carried out in the cases before, in the case of the torture of the law enforcement units, the results of the criminal proceedings were inconclusive. Turkey is a signatory to the European Convention on Human Rights, Prohibition of Torture, ‘No one shall be subjected to inhuman or degrading treatment or punishment.’
THE LEGAL PROCESSES WILL CONTINUE
In the statement stating that they will continue the legal struggle until they dismantle the torture, “as the bar associations, we are responsible for defending the rule of law and human rights. We will work without stopping until we dominate this country. Our goal in this statement we make is to defend the human rights and the law against the mentality that imposes unlawfulness. On this basis, we wish the investigation process to conclude in accordance with human rights and the law, and share this with respect to the public.
