In the Riha, Xalfeti district of Dergili (Dêrto) neighborhood, 18 people who were detained after the clash on May 18, the remaining 28 people were taken to court. 28 people were taking to the courthouse, their names as follows; Celal Ercan, Celal Yıldırım, Cindi Zincirkıran, Mehmet Alakuş, Zeki Alakuş, Besravi Atmaca, Fahrettin Alakuş, Fatma Alakuş, Mustafa Kahraman, Ömer Gül, Vakas Kılıç, Gazelay Alakuş and Mehmet Salih Yıldız. After the statements of the prosecutor, the detainees were referred to court with a request for arrest. 13 of the citizens were arrested on charges of being a member of a terrorist organization.
Abdullah Polat, Mahmut Pehlivan, Tacettin Gül, Feyzullah Gül, Emin Zincirkıran, Halil Zincirkıran, Mehmet Yıldırım, Uğur Yıldırım, Mustafa Yıldırım, Abdullah Yıldırım, Mehmet Korkmaz, Ahmet Korkmaz, M. Sait Çiftçi, Kader Çiftçi and Güler Alakuş with the order of prosecutor, were released.
MY STATEMENT WAS TAKEN UNDER TORTURE
Celal Yildirim, who had been in custody for 12 days, stated that he did not accept his statement on the files and that his statement had been taken under torture and demanded his release. Yildirim’s attorney, despite the written declaration, notified that during the statement process, the client suffered psychological and physical attacks, the statement was taken illegally and was to be used against his client. Yildirim’s lawyer, made clear that Yildirim is illiterate, and that in such cases statements are to be taken by an interpreter, but this was not done. The attorney requested the forensic assessment of Yildirim due to torture.
Another citizen who was tortured, Cindi Zincirkiran said in his defense that the statement had been taken under torture and that he did not accept the charges. His lawyer, who took the floor, then asked for his client to be released, stating that his client had not accepted his statement made in the police station, that his lawyer had not been present during the statements and that the statements had not been taken in accordance with the law.
WOMEN HAVE BEEN HARASSED
Fahrettin Alakuş said that his statement which was given in the police station had been taken under torture and that he did not accept those statements. Alakuş’s lawyer, said in his defense that at the time the statement was being taken, he was not let into the room. The lawyer said that his client was unable to explain the events that happened, that he was intensely tortured and that his client said that his wife was sexually harassed and that he could not explain. The lawyer noted that his client, who has children of 14,15 and 16 years old, had also been taken into custody and threatened with his children. The lawyer claimed that his client had been questioned under the force of torture and that he did not accepted the charges against him and that he has to be released.
Defending this in court, Fatma Alakus stated that she the testimony given at the police station, she did not understand anything, and that she has much to tell but could not because she is ashamed. “This is not justice. I don’t accept charges against me. The statement I gave in the law enforcement was given under torture, I do not accept it” she said.
‘I have a lot to say’
After the defence Gazaley Alakus, it was found out that her statements given to the police was also taken under torture. In her defense, Alakus said, they tortured me in private. They attacked me with a baton and kicks. They electrocuted me. They did more, but I can’t explain it from the environment.
